Hi, Nikki Butler – The Autistic Joyologist here, I am so excited that you are planning to purchase one of my self-study courses.  Before you buy the course there a few things you need to know about what you are purchasing, what you can expect and the support you will get from me. Please read the terms below and if you have any questions once you’ve finished, please do not hesitate to get in touch and I would be happy to answer questions.

The terms and conditions set out below apply to your purchase of self-study programmes and downloads from Nikki Butler – The Autistic Joyologist. Please read them carefully as they affect your rights and liabilities under law and set out the terms under which I  provide services to you, as purchaser of my online courses and products. These terms are subject to any rights you have under consumer law to which I am bound to and which cannot be waived.

Course Outline
My courses are self-study courses which are focused on providing educational content to support you in aligning your life to your values, dreams, goals, and passions, so that you can create a thriving, fulfilling and joyful life, and redefine success on your terms.
Each course clearly states what’s included, detailing the approximate number of lessons and information about downloads available.
Course content may be updated from time to time, to enhance and improve the user experience and to add more value.

Course Specifics
Following successful purchase of your chosen course(s) you will receive access to an online course portal, which includes learning modules, containing a combination of videos (with caption titles available if you view in YouTube), written content and pdf downloads. Not all elements are contained in every learning module.  The videos are pre-recorded, and the PDF Guides are available to download.
You will then have the opportunity to work through the course material in your own time. Each course provides you with information and guidance, to help you to follow a step by step process.


The courses have been tried and tested by individuals who are over the age of 18 and from various different backgrounds. In working through the material, they have been able to implement a number of changes to their lives, to bring it into alignment with their values, dreams, goals, and passions, and recognising their unique strengths and challenges.  This is a personal course for you to complete entirely at your own speed. For best results it is recommended that you under-take each module separately and allow for a short period of reflection in between each module.

Whilst all those who have taken the course to date have achieved the desired results, it is not possible to provide any guarantees that you will experience any specific results. Failure to complete the self-study materials will limit your ability to benefit from the information provided and will significantly limit any results. The course is not bespoke and includes general advice and guidance. Should you feel that you need additional support, then you may wish to consider working with me on a 1-2-1 basis. The material and guidance in the courses could cause additional issues to arise, as they require elements of personal reflection. At no point should you delay in obtaining medical input from health professionals if you feel that you need it.

It is not intended that you will finish the course with a complete and detailed bespoke transformation plan. The advice and guidance is general and informative and is designed to help you implement the tools into your life, to achieve your own unique desired results.  My online courses provide guidance, tools and educational materials to help you evaluate your life and to make changes to bring it into alignment with how you truly wish to live your life, so that you can take steps to create a thriving, fulfilled and happy life, on your terms.  It is your individual responsibility to apply what is shared and taught in the course to your personal circumstances both during the course and afterwards. Each individual is unique and their starting position and commitment to the course is unique to them. The aim is that following completion of my courses you will have new information, tools and techniques and have the knowledge and ability to create an aligned life, and to remain aligned.

Please be aware that the course is delivered entirely in English and no translations are provided for videos or text.


Payment Terms
The cost of the programmes are clearly set out on the page information for each course, and at the checkout.

Some courses will require payment in full at the time of purchase. This is a one-off payment and all purchases are final. (Please see below for details about refunds).
The option of paying the Course Fee in instalments is offered subject to availability, and only available for some courses. Acceptance of your offer to purchase the Online Course and pay the Course Fee by instalments is at the sole discretion of Nikki Butler – The Autistic Joyologist. Nikki Butler – The Autistic Joyologist may withdraw the option of paying the Course Fee in instalments at any time in its sole discretion. Any such withdrawal shall not affect customers who have already purchased an Online Course and are paying the Course Fee in instalments at the date of such withdrawal.

If you have elected to pay the Course Fee in instalments, you are agreeing to make all payments. If payments are missed, then you will be contacted and asked to make the missed payment within 48 hours. If payment remains outstanding within 7 days, we will take legal action to recover the monies. Please see below for our debt recovery process.

Support
The aim for this course is that you should be able to access the course material with ease. Should you require any technical support in respect of your PDF download or accessing the pre-recorded videos then we are happy to help you to get up and running. Please email hello@autisticjoyologist.co.uk and you will receive a reply within 2 working days between Monday to Thursday from 10am until 4pm. We aim to respond to you within one working day if you email during those hours, but there are occasions when it may take us 2 working days to respond.

Privacy and Confidentiality
Your privacy and protection of your personal data is important to me. We will keep your personal data confidential and will never share it with unconnected third parties. Your payment information will be processed by a secure third-party processor. We will be provided with your email address and name but never be provided with your financial information.

Refunds and Cancellation
 As you are purchasing digital content which includes data which is produced and supplied in digital form you are only entitled to a refund in limited circumstances.  In purchasing the courses you are waiving your rights to a refund unless the statutory circumstances for refunds are met.
As the content is available immediately, you will not be entitled to a refund once you have accessed the content. This means that once you have logged into your course, you will not be entitled to a refund, even if you have not started to watch the content.
 
If you have purchase a digital download then you will not be entitled to a refund as it is made available to you at the point of sale.
Should you consider that the digital download is faulty for any reason then please confirm so immediately and a further copy will be provided. Should you have any concerns or questions please contact me on hello@autisticjoyologist.co.uk

Intellectual Property
You will be provided with course materials. At all times, even following purchase, the intellectual property rights and copyright connected with those materials remain with me, Nikki Butler.  You have the right to use the materials as learning tools, but you are not permitted to duplicate, imitate or provide copies to third parties whether for free or as part of a sale.

The Autistic Joyologist is a registered Trademark.


Feedback and Complaints
If you have any feedback about the courses please do share it with us. It is always great to receive words of praise and also helpful to get constructive comments. I really hope that you love my courses as much as I do but if you would like to make a complaint this should be made to made in writing to Nikki Butler at hello@autisticjoyologist.co.uk. Please provide detailed information as to the nature of your complaint, so that we can assist you as quickly as possible.

General
These are self-led online learning courses, and you will not have direct support access while you are taking them unless you are working with me on a 1-2-1 basis or part of a group coaching program.

I intend to rely on the written terms set out in these terms and conditions in respect of the course delivered to you and your digital download purchases. These written terms shall constitute the entire agreement between us.
If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of these terms and conditions.
These Terms are governed by the laws of England & Wales. The Courts of England & Wales have exclusive jurisdiction over any matter and proceedings arising out of your purchase of the course.


Acceptance of Terms.
By registering for and/or using the Services in any manner, including but not limited to visiting or browsing the Site, you agree to these Terms of Service (including, for clarity, the Privacy Policy and, where applicable, the EU Data Processing Addendum) and all other operating rules, policies and procedures that may be published from time to time on the Site by us, each of which is incorporated by reference and each of which may be updated from time to time without notice to you.

Certain of the Services may be subject to additional terms and conditions specified by us from time to time; your use of such Services is subject to those additional terms and conditions, which are incorporated into these Terms of Service by this reference.

These Terms of Service apply to all users of the Services, including, without limitation, users who are contributors of content, information, and other materials or services, registered or otherwise.

Debt recovery

If you have failed to make payment, then we will pursue legal action to recover any monies owed. In the event that you miss a payment we will: 

1. Send an email advising you of your missed payment, and a request to pay within 48 hours. 
2. If payment is not made within 48 hours we will send a formal notice email requesting payment within 14 days from the missed payment date.
3. If payment is not made within 14 days, you will receive a final notice to pay within 14 days. 
4. If payment remains outstanding after 30 days, we will send a formal final demand notice email and where possible, letter, notifying you of our intent to issue legal proceedings. 
5. If payment remains outstanding then we pass the matter to a debt recovery agent, who will manage matters on our behalf. 

You will be liable for all of our associated fees for debt recovery and legal recovery of outstanding payments. 


Eligibility.

You represent and warrant that you are at least 16 years of age. If you are under age 16, you may not, under any circumstances or for any reason, access or use the Services. We may, in our sole discretion, refuse to offer the Services to any person or entity and change its eligibility criteria at any time. You are solely responsible for ensuring that these Terms of Service are in compliance with all laws, rules and regulations applicable to you and the right to access the Services is revoked where these Terms of Service or use of the Services is prohibited or to the extent offering, sale or provision of the Services conflicts with any applicable law, rule or regulation. Further, the Services are offered only for your use, and not for the use or benefit of any third party. If you are registering with Podia on behalf of an entity or a third party, you represent and warrant that you have full authority to bind that entity to these Terms of Service.


Processing of Personal Data

Content.

A. Definition. For purposes of these Terms of Service, the term “Content” includes, without limitation, information, data, text, photographs, videos, audio clips, written posts and comments, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible on or through the Services. For the purposes of this Agreement, “Content” also includes all User Content (as defined below).

Notices and Restrictions.
The Services may contain Content specifically provided by us, our partners or our users and such Content is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. You shall abide by and maintain all copyright notices, information, and restrictions contained in any Content accessed through the Services.

Availability of Content.
We do not guarantee that any Content will be made available on the Site or through the Services. We reserve the right to, but do not have any obligation to, (i) remove, edit or modify any Content in our sole discretion, at any time, without notice to you and for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if we are concerned that you may have violated these Terms of Service, or for no reason at all and (ii) to remove or block any Content from the Services.

Rules of Conduct.
A. As a condition of use, you promise not to use the Services for any purpose that is prohibited by these Terms of Service. You are responsible for all of your activity, and all activity connected to your Account in connection with the Services (including without limitation your communications and collection of data from other users of the Services).

B. You shall not (and shall not permit any third party to) either (a) take any action or (b) upload, download, post, submit or otherwise distribute or facilitate distribution of any Content, including without limitation User Content, on or through the Services that:
i. infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity, or violates any law, rule, or regulation (whether domestic, foreign, or international) or contractual duty;
ii. violates these Terms of Service;
iii. you know is false, misleading, untruthful or inaccurate;
iv. is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, vulgar, pornographic, offensive, profane, contains or depicts nudity, contains or depicts sexual activity, or is otherwise inappropriate as determined by us in our sole discretion;
v. constitutes unauthorized or unsolicited advertising, junk or bulk e-mail (“spamming”);
vi. contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equ ipment or to damage or obtain unauthorized access to any system, data, password or other information of ours or of any third party;
vii. impersonates any person or entity, including any of our employees or representatives; or
viii. includes anyone’s identification documents or sensitive financial information.

Third Party Services.
The Services may permit you to link to other websites, services or resources on the Internet, and other websites, services or resources may contain links to the Services. When you access third party resources on the Internet, you do so at your own risk. These other resources are not under our control, and you acknowledge that we are not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources. The inclusion of any such link does not imply our endorsement or any association between us and their operators. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such website or resource.

Payments and Billing.

Billing. We use a third-party payment processor (the “Payment Processor”) to bill you through a payment account linked to your Account on the Services (your “Billing Account”) for use of the Paid Services. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to these Terms of Service. We are not responsible for error by the Payment Processor. By choosing to use Paid Services, you agree to pay us, through the Payment Processor, all charges at the prices then in effect for any use of such Paid Services in accordance with the applicable payment terms and you authorize us, through the Payment Processor, to charge your chosen payment provider (your “Payment Method”). You agree to make payment using that selected Payment Method. We reserve the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

Payment Method. The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method. If we, through the Payment Processor, do not receive payment from you, you agree to pay all amounts due on your Billing Account upon demand.

WE DO NOT GUARANTEE THAT THE SERVICES WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS. IN PARTICULAR, THE OPERATION OF THE SERVICES MAY BE INTERRUPTED DUE TO MAINTENANCE, UPDATES, OR SYSTEM OR NETWORK FAILURES, AND SUCH FAILURES MAY RESULT IN ERRORS OR DATA LOSS. WE DISCLAIM ALL LIABILITY FOR DAMAGES CAUSED BY ANY SUCH INTERRUPTION OR ERRORS IN FUNCTIONING, OR BY THE LOSS OF ANY DATA OR INFORMATION YOU PROVIDE TO PODIA. FURTHERMORE, WE DISCLAIM ALL LIABILITY FOR ANY MALFUNCTIONING, IMPOSSIBILITY OF ACCESS, OR POOR USE CONDITIONS OF THE SERVICES DUE TO INAPPROPRIATE EQUIPMENT, DISTURBANCES RELATED TO INTERNET SERVICE PROVIDERS, TO THE SATURATION OF THE INTERNET NETWORK, AND FOR ANY OTHER REASON.
